1. Introduction

These General Terms and Conditions of Sale (hereinafter “Terms”) govern the offer and conclusion of distance purchase contracts for products marketed on the website www.mb-industry.it (hereinafter referred to as the “Site”).

The products are sold directly by MB-Industry of Bolognesi Manuel (hereinafter referred to as “Vendor” or “We”), with registered office at Via Vincenzo Zanasi 7, 44034 Copparo (FE), VAT no. IT01948540388, email: service@mb-industry.it, tel: 3405745425.

The customer making purchases on the Site (hereinafter referred to as “Customer” or “You”) is required to read these Terms carefully before placing an order. Sending the order implies full knowledge and acceptance of them.

2. Definitions

  • Site: the website www.mb-industry.it
  • Seller/owner: MB-Industry of Bolognesi Manuel
  • Customer/Consumer: the natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out (Art. 3(a) Legislative Decree 206/2005)
  • Professional: a natural or legal person acting in the exercise of his or her trade, business, craft or profession
  • Product(s): the tangible goods offered for sale on the Site
  • Order: the purchase proposal sent by the Customer to the Seller
  • Contract: the distance sales contract concluded between the seller and the customer
  • Working days: daily from Monday to Friday, excluding public holidays

3. Subject matter of the contract

3.1 By these Conditions, the Seller sells and the Customer purchases at a distance the products indicated and offered for sale on the Site.

3.2 The essential characteristics of the products are presented on the Site within each product sheet. The images and colours of the products may not correspond exactly to the real ones due to the graphic settings of the device used for navigation.

4. Conclusion of the contract

4.1 To conclude the contract, the Customer must complete the order form in electronic format and send it to the Seller following the instructions on the Site, expressly accepting these Conditions.

4.2 The order sent by the Customer has the value of a contractual proposal. The contract is concluded when the Customer receives from the Seller, at the e-mail address indicated, confirmation of the acceptance of the order (“Order Confirmation”).

4.3 The Seller reserves the right not to accept orders from customers with whom a legal dispute is pending, or who have previously violated these Conditions.

4.4 In the event of unavailability of the product ordered, the Seller undertakes to promptly notify the Customer by email. In this case, no amount shall be charged to the Customer and any sum already paid shall be refunded.

5. Availability of products

5.1 The availability of products indicated on the Site is purely indicative and not binding, in view of the possibility of simultaneous purchases by several users.

5.2 In the event of stock-outs after the order has been sent, the Seller shall promptly notify the Customer of the unavailability of the product and refund any sums already paid.

6. Prices and payment methods

6.1 Product prices are in Euro and include VAT, unless otherwise indicated.

6.2 Shipping costs are clearly indicated when ordering and are separate from the price of the products. They are charged to the customer.

6.3 The Seller reserves the right to change prices at any time, it being understood that the price applied shall be the price in force at the time the order is placed by the Customer.

6.4 Payment can be made by the methods indicated on the Site when placing the order (credit cards, PayPal, bank transfer, etc.). The charge will be made upon conclusion of the contract.

7. Shipping and Delivery

7.1 The products will be delivered to the address indicated by the Customer in the order, by the chosen shipping method and within the estimated time indicated at the time of the order.

7.2 Delivery times are purely indicative and not binding. The Seller is not liable for delays attributable to the courier or force majeure.

7.3 Upon delivery, the Customer is obliged to check:

  • That the number of packages corresponds to the number indicated in the transport document
  • That the packaging is undamaged, not damaged, not wet or altered

7.4 Any damage or tampering must be immediately reported to the courier by affixing the word “ACCEPTANCE WITH RESERVE” on the proof of delivery. Thereafter, within 7 days, the Customer shall send a detailed report to the Seller.

7.5 The goods travel at the Customer's risk. The Seller shall not be liable for any damage occurring to the products after delivery to the carrier, without prejudice to the Customer's right to take direct action against the carrier.

8. Invoicing

8.1 For each purchase made on the Site, the Seller shall issue an invoice for the material shipped. The data provided by the Customer when placing the order will be included in the invoice.

8.2 No changes in tax data will be possible after the invoice has been issued.

8.3 For the issuance of the invoice, the information provided by the customer shall be authoritative, and the customer assumes full responsibility for the correctness of that information.

9. Right of Withdrawal

9.1 Right of Withdrawal
A customer who is a consumer (natural person acting for purposes other than business activity) has the right to withdraw from the contract within 14 days without having to provide any reasons.

The right of withdrawal does not apply to purchases made by professionals under the B2B regime.

9.2 Time limit for exercising withdrawal
The withdrawal period expires after 14 days from the day on which the Customer or a third party appointed by him (other than the courier) acquires physical possession of the goods.

In the case of multiple orders with separate deliveries, the term commences on the day on which the Customer acquires physical possession of the last good.

9.3 Methods of exercising withdrawal
To exercise the right of withdrawal, the Customer must inform the Seller of its decision to withdraw by means of an express declaration sent to

9.4 Effects of Withdrawal
If the Customer withdraws from the contract, he will be refunded all payments made, including delivery costs (with the exception of any additional costs resulting from choosing a type of delivery other than the least expensive type offered).

The refund will be made within 14 days of receipt of the notice of withdrawal, using the same means of payment as was used for the purchase. The refund may be withheld until receipt of the goods or until proof of resending.

9.5 Return of Goods
The customer must return the goods within 14 days of the notice of withdrawal, to the above address.

The costs of return shall be borne by the Customer.

9.6 Condition of Assets
The Customer shall be liable for any decrease in the value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9.7 Exceptions to the right of withdrawal
The right of withdrawal is excluded for:

  • Tailor-made or clearly customised products
  • Products which, after delivery, are inseparably mixed with other goods
  • Software and files (e.g. STL, OBJ, etc.)

10. Legal guarantee of conformity

10.1 All products sold by the Seller are covered by the legal 24-month conformity warranty provided for in Articles 128 et seq. of Legislative Decree 206/2005 (Consumer Code).

10.2 The guarantee applies exclusively to consumers. For professionals, any conventional warranties indicated by the manufacturer apply.

10.3 The lack of conformity must be reported to the Seller within two months of its discovery, under penalty of forfeiture.

10.4 In the event of a conformity defect, the Customer has the right:

  • To the repair or replacement of the good, free of charge
  • Alternatively, reduction of the price or termination of the contract in cases provided for by law

10.5 They are excluded from the guarantee:

  • Materials subject to wear and tear (batteries, keyboards, cables, power supplies, etc.).
  • Damage resulting from misuse, tampering, incorrect installation or accidental causes (falls, electrical surges, etc.).
  • Products that have undergone unauthorised modifications

10.6 The Vendor shall not be liable for direct or indirect damage to persons or property resulting from damage to or improper use of the product.

11. Liability

11.1 Limitations of Liability
Except as provided by law for cases of intent or gross negligence, the Seller shall not be liable for:

  • Loss of profit or loss of earnings
  • Indirect or consequential damage of any kind
  • Damage resulting from business interruptions
  • Loss or damage of data

11.2 The Vendor shall not be liable for delays or non-performance due to force majeure (unforeseeable and unavoidable events beyond its reasonable control, such as wars, riots, fires, floods, acts of public authorities, strikes, interruptions of energy supplies or telecommunication services).

12. Returns and Repairs

12.1 Returns
Any returns must be agreed in advance with the Vendor by contacting service@mb-industry.it. Returns must be sent carriage paid (costs borne by the sender) and with adequate packaging. Otherwise, the goods will be rejected.

12.2 Repairs
The return of non-functional material must be authorised in advance by the returns department.

  • Within 30 days of purchase: defective material will be replaced
  • More than 30 days: will be sent to the service centre for repair, with technical time required
  • Material sent in for repair that does not have any defects will be returned at the expense of the Customer
  • No refund requests will be accepted for material judged to be functional or for hardware/software incompatibility problems of the user's system

13. Packages returned due to customer unavailability

In the event that an order is returned to the Seller for non-delivery due to the Customer's unavailability or refusal of acceptance, the following procedure shall be followed:

  • Return of the envelope: The Customer shall incur a penalty of € 15.00 as reimbursement of handling and return costs. Payment shall be made in advance. The Customer shall have 10 days from the communication to request resending.
  • Reimbursement without re-sending: If the Customer is not interested in resending, the Seller will make a refund of the value of the goods only (excluding shipping costs), retaining €15.00 for handling costs. The refund shall be made upon written request of the Customer.

14. Intellectual Property

14.1 All content on the Site (text, images, logos, graphics, videos, software) is the exclusive property of the Vendor or its licensors and is protected by copyright and intellectual property laws.

14.2 Reproduction, modification or distribution of the contents of the Site is prohibited. for commercial purposes without the Seller's consent. Sharing on social networks and for personal use is instead free and encouraged, with an invitation to cite the source.

14.3 The trademarks and logos on the Site are the property of their respective owners.

15. Links to third-party sites

15.1 The Site may contain hyperlinks to third party websites. The Seller does not control such sites and is not responsible for their content, privacy policies or practices.

15.2 Access to third-party sites is at the sole risk of the customer.

16. Electronic Communications

By using the Site or communicating with the Seller electronically, the Customer agrees to receive electronic communications from the Seller (by email or through the Site) and acknowledges that such communications satisfy the written form requirements of the law.

17. Processing of personal data

17.1 The Customer's personal data will be processed by the Seller in accordance with EU Regulation 2016/679 (GDPR) and Legislative Decree 196/2003 (Privacy Code).

17.2 For all information on the processing of personal data, please consult the Privacy Policy and the Cookie Policy of the Site.

18. Changes to Terms and Conditions

18.1 The Seller reserves the right to amend or update these Terms and Conditions at any time. Amendments shall be effective from the time of their publication on the Site.

18.2 Orders sent before the publication of the changes will remain subject to the Terms and Conditions in force at the time the order was sent.

19. Assignment of contract

The Customer may not assign, transfer or subcontract any of its rights or obligations under these Terms and Conditions without the prior written consent of the Seller. Any assignment in violation of this provision shall be null and void.

20. Breach of time limits

In the event of any breach of these Terms and Conditions, the Seller reserves the right to take any action deemed appropriate, including temporary or permanent suspension of access to the Site, reporting to the Internet service provider and taking legal action.

21. Force majeure

The Vendor shall not be liable for delays or non-performance due to force majeure, meaning unforeseeable and unavoidable events beyond its reasonable control, including but not limited to: wars, riots, fires, floods, acts of public authorities, strikes, interruptions of energy supplies or telecommunication services, pandemics.

22. Applicable Law and Jurisdiction

22.1 Applicable law
These Terms and Conditions are governed by Italian law.

22.2 Online Dispute Resolution (ODR)
Consumers resident in the European Union can access the Online Dispute Resolution (ODR) platform at the following link: https://ec.europa.eu/consumers/odr/. Our email address is service@mb-industry.it.

22.3 Jurisdiction

  • For consumers: The place of jurisdiction is the consumer's place of residence or domicile, if located in Italy.
  • For professionals and all other disputes: Territorial competence lies exclusively with the Forum of Ferrara.
